the important thing to remember is that if someone does that to you and clearly isn’t realizing you’re there, and you can’t brake/speed out of it, let them hit you and let them be at fault. because if you instinctively swerve and hit something/someone else, you are now at fault for that collision.

Not here. If you hit someone/something because you’ve been forced off, and you can prove that (video, witnesses, etc.) then the person who forced you off will be declared at fault, even if they’ve long since fucked off. The police will look for them and charge them for causing an accident.
